Celebration of the National Week for Approval of Constitution:

State Ministry for Parliamentary Affairs (SMPA) celebrated the National Week of Constitutional Approval. The ceremony was attended by Minister of State for Parliamentary Affairs, Ghulam Farooq Wardak, and Mr. Qasim Hashmzai, head of the oversight commission for enforcement of constitution. 

At the outset, Minister of State for Parliamentary Affairs discussed the history of drafting, verification and ratification of the constitution and its national legacy on three main principles: national unity, legitimacy of the system and unity of the Afghan Nation.  Mr Wardak who also has served as the head of the secretariat for drafting, scrutiny and approval of the constitution, pointed out the problems of the time:  adding that on one hand, the country had been freshly gotten out of a bloody war for more than three decades, on the other hand there were no proper working procedures, financial and technical resources to carry out the burden in accordance with the Bonn Agreement. There were also no directive documents in hand on which the Commission would utilize those limited resources to carry out a completely new process for adoption of a constitution. 

Dr. Ghulam Farooq Wardak added that the country's current constitution is not merely product of the commission members’ thoughts; but it is a product of ideas, experiences, shortcomings of previous laws, and the demand of Afghan Nation. The Commission conducted in-depth and collected ideas and inquiries from intellectual Afghans both in and out of the country.  Approximately 2.7 million Afghans shared their problems of past laws, national aspirations and the demands of their personal lives. These ideas were accessed, analyzed and saved at the computers by the Secretariat for editing process. These rich ideas were submitted to the Commission, which forms the backbone of the current constitution.  For this reason, it can be claimed that Afghanistan has such a constitution that is not the product of the minds of several legislators; but every single letter and meaning is the out-come of the rich sources and fully reflect wishes of the Afghan nation.

Minister of State for Parliamentary Affairs called this very constitution unprecedented at the region level and said this national document encompasses the major goals of our country such as the legitimate foundation for reconstruction, the establishment and strengthening of foundations, establishment of lasting peace and roll of the triple pillars of the state.  

Mr. Wardak told that determination of capabilities and responsibilities, the interactions between the three forces and the relations of the country with other countries are well established in this constitution. State Minister added that amendment in humanitarian laws is a timely necessity, he said that during the course of last 16 years, he had got several specific reform proposals, which will be submitted according to the terms and conditions of the constitutional amendment as often as the ground is ready for that.

Speaking at the ceremony, Head of the Constitution Enforcement Commission, Mr. Qasim Hashimzai said that the implementation of the constitution is somewhat problematic because of the current ongoing war in the country. He also said that because of this constitution, we have a permanent and inclusive legal state and we must support it.  Mr. Hashimzai hoped that after the success of peace process in the country, some of the existing gaps in the constitution will be resolved, too.

At the end, Mr. Niamatullah Mahmoodi, head of the Legislative Department and Mrs. Rahima Popalzai, legislative advisor both from state ministry expressed about the importance and smooth role of the constitution in democratic societies, respectively.
